In accordance with Articles 13, 14 and 21 of the European Data Protection Regulation (hereinafter referred to as DSGVO) and § 32, 33 of the Federal Data Protection Act of the Federal Republic of Germany (hereinafter referred to as BDSG) and Article 5 of the Data Protection Act of Liechtenstein (hereinafter referred to as DSG).
We take the confidentiality of your data within the framework of the applicable provisions of data protection law very seriously. The protection and lawful collection, processing and use of your data is therefore an important concern for us. SWM AG therefore uses both technical and organisational measures to protect your data from manipulation, loss, destruction or access by unauthorised persons. Our security measures are constantly being developed in line with technological progress.
In the following, we inform you about the processing of your personal data by SWM AG and the rights to which you are entitled under data protection law.

We process your personal data in compliance with the EU General Data Protection Regulation (GDPR), the Federal Data Protection Act (BDSG-Federal Republic of Germany), the Data Protection Act (DSG-Liechtenstein), and all other applicable laws.
We need your data in order to be able to perform the agreed contractual obligations for you to buy, sell and manage commodities. The execution of the contract is not possible without the processing of your data.
The legal basis for this processing of personal data for pre-contractual and contractual purposes is Art. 6 para. 1 b of the DSGVO. We also process your data if it is necessary under Art. 6 (1) f of the DSGVO to protect legitimate interests of us or of third parties. This may be necessary in particular
- to advertise our own products
- to ensure IT security and IT operations
- for the prevention and investigation of criminal offences.
In addition, we process your personal data to comply with legal obligations (for example, regulatory requirements, commercial and tax retention obligations). In this case, the respective legal regulations in conjunction with Art. 6 (1) c of the DSGVO serve as the legal basis for the processing.
Should we wish to process your personal data for a purpose not mentioned above, we will inform you of this in advance within the framework of the legal provisions. The revocation has no retroactive effect. It does not affect the legal validity of the data processing carried out on the basis of the previous consent until receipt of the revocation.
Data collection when visiting our website
Each time our website is accessed, our system automatically collects data and information from the computer system of the accessing computer.

The temporary storage of the IP address by the system is necessary to enable delivery of the website to the user's computer. For this purpose, the user's IP address is stored for the duration of the session.
Cookies
Some of the Internet pages use so-called cookies. Cookies are text files that are stored on a computer system via an internet browser. Numerous Internet pages and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string of characters by which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This enables the visited Internet pages and servers to distinguish the individual browser of the data subject from other Internet browsers that contain other cookies. A specific internet browser can be recognised and identified via the unique cookie ID. Through the use of cookies, we can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.
By means of a cookie, the information and offers on our website can be optimised for the benefit of the user. As already mentioned, cookies enable us to recognise the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter his or her access data each time he or she visits the website, because this is done by the website and the cookie stored on the user's computer system.
The data subject can prevent the setting of cookies by our website at any time by means of an appropriate setting of the Internet browser used and thus permanently object to the setting of cookies. Google Web Fonts
This site uses so-called web fonts provided by Google for the uniform display of fonts. Google Web Fonts are used in the interest of a uniform and appealing presentation of our online offers. If your browser does not support web fonts, a standard font will be used by your computer.
The Google fonts on this page are integrated statically, i.e. they are loaded via our own domain instead of dynamically from the Google server; no IP addresses are transmitted to Google in the USA because of the fonts.

Who gets your data

- If your contracts are managed by an intermediary, the intermediary will process your application data until the contract is concluded.
- External contractors/service providers
- In order to fulfil our contractual and legal obligations, we are sometimes supported by external service providers.
- Additional recipients
- We may also transfer your personal data to additional recipients, such as public authorities to fulfil legal notification obligations (for example, financial or law enforcement authorities).
Duration of storage of personal data
Your personal data will be deleted as soon as it is no longer required for the above-mentioned purposes. It may be necessary to retain personal data for the period of time during which claims can be made against our company (statutory limitation period of 3 to 30 years).
We also store your personal data for as long as we are legally obliged to do so. Corresponding obligations to provide proof and to store data result, among other things, from the German Commercial Code, the German Fiscal Code and the German Money Laundering Act. The storage periods are then up to 10 years.
Rights of the person concerned
You can request information about your personal stored data. You can also request the provision of your personal stored data in a structured, common and machine-readable format.
If we have stored incorrect information about you, you can request that your data be corrected.
You also have the right to request completion of your personal data, taking into account the purposes of the processing.
Under certain conditions, you can request the deletion of your data.
Furthermore, you may be granted the right to restrict the processing of your data.
Right of objection
If there are special reasons, you can object to data processing in accordance with Article 6 (1) f of the DSGVO.
You may object to the processing of your personal data for direct marketing purposes.
